These terms of service ("Terms") are an agreement between you and Coffee Filter ("Coffee Filter", "we", "us" or "our"). They cover the Coffee Filter iPhone app, coffeefilter.app, and the servers behind them (together, the "Service").
By creating an account or otherwise using the Service, you agree to these Terms and to our privacy policy. If you don't agree, don't use the Service.
Who can use Coffee Filter
You must be at least 13 years old to use the Service. If you're under the age of majority where you live, you may only use the Service with the permission of a parent or guardian, who agrees to these Terms on your behalf. You may not use the Service if the law prohibits you from doing so, or if we've previously closed your account for breaking these Terms.
Your account
- You create an account by signing in with Apple, and you're responsible for keeping access to your Apple ID secure and for everything that happens under your account.
- Each iPhone can create one Coffee Filter account. If an iPhone has already created one, you'll be asked to sign in with the Apple ID you used before. Don't try to get around this limit.
- Your account is personal: don't share it, sell it, or let anyone else use it.
- You can delete your account at any time in Settings → Account → Delete account. Our privacy policy explains what happens to your data when you do.
Your license to use Coffee Filter
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the app on Apple devices you own or control, and to use the Service, for your own personal, non-commercial use. All rights not expressly granted are reserved by Coffee Filter.
Fair use and check-ins
Coffee Filter scores shops by how many people come back, so scores only mean something if check-ins are real. When you use the Service, you agree not to:
- check in at a shop you aren't at, fake or spoof your location, or check in on someone else's behalf;
- create more than one account, use someone else's account, or get around the one account per iPhone limit;
- try to raise or lower any shop's score, including a shop you own, work for or compete with, by any means other than genuine visits;
- submit shops, edits or other content that is false, misleading, offensive, unlawful, or that you don't have the right to share;
- access the Service with bots, scripts or other automated means, or copy, scrape or harvest shop listings, scores or other data from it;
- interfere with, disrupt, overload, or try to gain unauthorized access to the Service, its servers or other people's accounts, or probe or test its security without our written permission;
- copy, modify, distribute, sell or lease any part of the Service, or reverse engineer or try to extract its source code, except where the law allows it;
- use the Service in any way that breaks the law or these Terms.
We may verify, reject or remove check-ins, reasons and submissions that we believe break these rules, recalculate the scores they affected, and suspend or close the accounts responsible.
Content you provide
You keep ownership of the content you provide to the Service, such as your visit notes, the reasons you give for coming back, and the shops and edits you submit ("Your Content"). Your visit notes are private and we use them only to show them back to you.
For everything else you provide, you grant Coffee Filter a worldwide, non-exclusive, royalty-free, perpetual license to use, store, copy, modify, and display it to operate, improve and promote the Service: for example, to calculate shop scores and top reasons, which everyone using Coffee Filter can see as totals that don't identify you, and to add or correct shop listings. This license continues after you delete your account for content that has already been combined into shop listings or scores. You confirm that you have the right to provide Your Content and that it doesn't infringe anyone else's rights.
Feedback
If you send us ideas, suggestions or other feedback about the Service, we may use them without any obligation to you.
Shop information and scores
Shop listings, hours, addresses and other details come from several sources, including people using Coffee Filter, and may be incomplete, out of date or wrong. Scores, reasons, busy times and other figures reflect what people using Coffee Filter have done; they aren't our opinion of a shop, a review, or a guarantee of quality, safety or service. Check with a shop before you make a special trip.
Shops don't pay to be listed, scored or ranked, and listing a shop doesn't mean the shop endorses or is affiliated with Coffee Filter. Anything you buy at a shop, and anything that happens there, is between you and the shop.
Third-party services
The Service relies on, and links to, services we don't control, including Apple's Sign in with Apple and Apple Maps, Google Maps (if you choose it for directions), and shops' own websites and Instagram pages. Your use of them is governed by their own terms and privacy policies, and we aren't responsible for them.
Intellectual property
The Service, including the app, the website, our software, designs, text, graphics, logos and the Coffee Filter name, and the shop scores and other data we compile, is owned by Coffee Filter or our licensors and protected by copyright, trademark and other laws. Except for Your Content, you may not reproduce, distribute, sell or exploit any part of the Service without our written permission.
Changes to the Service
Coffee Filter is new, and the Service will change. We may add, change, or remove features, change how scores are calculated, limit the Service to certain areas, or stop offering it, temporarily or permanently.
Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or close your account, or restrict your access to the Service, if you break these Terms, if we're required to by law, or if your use creates risk or legal exposure for us or for others. Where reasonable, we'll tell you why. These Terms continue to apply until your account is deleted. The sections on content you provide, feedback, intellectual property, disclaimers, limitation of liability, indemnification, and disputes continue after that.
Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't warrant that the Service will be uninterrupted, secure or error-free, that shop information or scores will be accurate or complete, or that any defects will be corrected. Some places don't allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent the law allows, Coffee Filter will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, use or goodwill, arising out of or related to the Service or these Terms, even if we've been told such damages are possible. This includes anything that happens at, or on the way to, a shop you find through the Service. Nothing in these Terms limits liability that can't be limited by law.
Indemnification
To the extent the law allows, you agree to indemnify and hold harmless Coffee Filter from any claims, damages, losses and expenses (including reasonable legal fees) arising out of Your Content, your misuse of the Service, or your breach of these Terms or the law.
Apple
If you got the app from Apple's App Store, the following also applies:
- These Terms are between you and Coffee Filter only, not Apple. Coffee Filter, not Apple, is solely responsible for the app and its content.
- Your license to use the app is limited to Apple-branded products you own or control, as permitted by the App Store's Usage Rules.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Coffee Filter's responsibility.
- Coffee Filter, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your possession and use of it infringes their intellectual property rights, Coffee Filter, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, have the right to enforce them against you as a third-party beneficiary.

Disputes
If you have a dispute with us, please email us first so we can try to resolve it informally. These Terms don't take away any rights you have under consumer protection laws that apply to you.
Changes to these Terms
We may update these Terms from time to time. When we do, we'll post the new version here and update the date at the top. If you keep using the Service after the new Terms take effect, you accept them; if you don't agree, stop using the Service and delete your account.
General
- Entire agreement: these Terms and our privacy policy are the entire agreement between you and Coffee Filter about the Service.
- Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver: if we don't enforce part of these Terms, that doesn't waive our right to do so later.
- Assignment: you may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of assets.
- Events beyond our control: we aren't responsible for failures or delays caused by events outside our reasonable control.
